TERMS & CONDITIONS FOR TENANTS
We have set out below our Terms and Conditions when renting a property from Stephen Oakley & Co.
Please read these terms carefully all tenants must sign the declaration on the last page.
All applications are accepted only on a Subject to Contract basis
RESERVING A PROPERTY
To reserve a property, a reservation fee which is currently £220.00 plus VAT (£44.00), must be paid along with completed application forms. The fee covers the referencing of for the property for 1 prospective tenant and £262.50 plus VAT (£56.50) for 2 prospective tenants. Company referencing is £262.50 plus VAT (£56.50). A Check out fee of £50.00 plus VAT (£10.00) is also applicable. These fees are non-refundable.
A full refund is returned to the applicant if the Landlord withdraws the property, while referencing is taking place. We will continue to advertise the property, but NO other reservation fees will be taken for the property, until your referencing is completed and the result is known.
We recommend the reservation fee be paid as soon as possible, to avoid disappointment.
When the reservation fee has been paid and all applicants over the age of 18 have completed a referencing form, we will send them to our independent referencing company, currently FLS. A full credit reference will be carried out.
Please note: If you are self employed, the referencing company will possibly require sight of the last three years of accounts.
A further £62.50 plus VAT (£12.50), will be charged for each additional applicant or guarantor needed. Once the referencing process is complete, you will be contacted by our office.
When moving into a property you will need to pay a dilapidation deposit to Stephen Oakley & Co, as agent to the Landlord, this is held for the duration of the tenancy in a TDS Scheme or the Landlord is to place this in their own scheme. On termination of the contract, this deposit will be used to offset any agreed dilapidations beyond general fair wear and tear.
The amount of deposit is currently one and a half’s month’s rent. This deposit cannot be used as the final rent payment.
If it has been agreed by the Landlord for a pet/s to be kept at the property, a further £50.00 plus VAT (£10.00) for a Pet Clause policy fee needs to be paid and a deposit of two month’s rent.
The dilapidations deposit CAN be used at any time in respect of rent arrears due to the Landlord or, outstanding fee due to Stephen Oakley & Co. Payment of rent from the dilapidations deposit shall not be constructed as discharging your liability to pay rent due under the terms of your tenancy. Any deductions cannot be made without your authorisation.
An appointment will be made for all parties to attend the office, which will take place during the hours of, Monday – Friday 9.30am to 5.30pm and Saturdays 9.30am and 3.30pm. If arrangements have to be made outside these times, a fee of £50.00 plus VAT (£10.00), can be chargeable to the tenant.
Under NO circumstances will tenants be checked into a property until;
1. All necessary fees and payments (i.e., first month’s rent, deposit and check out fee) have been made in full by way of cleared funds, i.e., Bankers Draft or Telegraphic Transfer. Debit card payments are acceptable proving payment is made a minimum of 5 working days before the commencement of the Tenancy.
2. All tenants have signed all the necessary legal documentation.
The check-in will take place at the office where receipt of the inventory will be signed for. One full set, plus an additional set of front door keys if there are 2 tenants, will be handed over upon commencement. If you require any further sets of keys, we can arrange this at a cost to you and all keys must be handed back to Stephen Oakley & Co, when you vacate the property.
